We at item Industrietechnik GmbH (“item”) take our responsibility under data protection law very seriously. The protection of your privacy and your personal data is accordingly important for us. Therefore, we would like to provide this Privacy Policy to you in which we describe our online data practice as well as your possibilities to choose with regard to the collection and use of your personal data.

The website “https://www.item24us.shop” (the “Website”) is operated by item. item is the controller of the personal data of the Website users (“you”).

We would like to explain in more detail below which personal data are collected by whom during your visit to our Website and how these data are used. We collect, process and use your personal data in accordance with this Privacy Policy as well as the applicable data protection laws.

 

The term “personal data” is understood to mean any information concerning the personal or material circumstances of an identified or identifiable individual. This includes information such as, for example, your name, your address and your telephone number.

Statistical/aggregated information which cannot be connected to you, such as, e.g. the number of users on a site, are not personal data.

1.1 Usage data automatically collected when visiting our Website

To the extent you do not log in, register or otherwise transmit information to us when using the Website, item – just as every other website – only collects data which your browser automatically transmits in order to enable you to visit our website. These so-called usage data are entered in protocols in server log files.

  • These are the following data:
  • IP address (internet protocol address) for the computer from which access was obtained to our Website;
  • internet address of the website from where the Website was accessed (so-called origin or referrer URL); name of the service provider through which access to the Website was obtained;
  • name of the called up data files and information;
  • date and time as well as duration of the access;
  • transmitted data volume;
  • operating system and information on the internet browser of the computer accessing the Website;
  • http-status-code (e.g. “inquiry successful” or “requested data file not found”).

IP addresses and log file information of the type set forth above are stored by item for a limited period of time for security reasons (e.g. for the purpose of identification of attempted attacks).

1.2 Personal data collected when registering for our Website

We collect, store, process and use the personal data provided by you when establishing a user account (i) to provide our product and service information as well as (ii) for establishing, performing and completing the contracts concluded with us by means of the webshop.

In order to be able to use product and services information as well as our webshop, you must register and establish a user account.

Necessary mandatory information you have to provide in order to access our product and service information is separately marked, and other information is voluntary. We collect the following data in this respect:

 

  • first name and last name;
  • email address;
  • company name;
  • address;
  • country;
  • telephone number;
  • field of business;
  • field of activity of the registering person;
  • a password of your choice.

In order to carry out the online sale, i.e. for establishing, performing and completing the contracts concluded with us by means of the webshop, we also collect your

 

  • value added tax identification number (without this information, no contract can be concluded with us);
  • payment information or bank account details;
  • shipping information (for example, the invoice and delivery address if different from the address already notified).

When setting up a user account, the data entered by you are stored in a revocable manner. You can always amend the data you have provided or delete the account in the customer area.

1.3 Personal data in the context of the newsletter

You can register for receiving our newsletter by email by means of your express consent. We use Eloqua for this purpose, as described below in Section 4.3. The IP address with the point in time is stored when registering for the newsletter and confirming the registration in order to be able to prove the registration in the case of doubt. Upon registration for the newsletter, we collect the following data:

 

  • email;
  • first name and last name;
  • your consent.

The newsletter can be cancelled at any time at datenschutz(at)item24.com.

1.4 Other personal data

In addition to the above mentioned usage data, item collects and processes personal data if you provide the data to us, for example, if you contact us by email. Especially the following personal data can be collected in this regard:

 

  • first name, last name;
  • any (company) address data (street, building number, postal code, city);
  • email address;
  • content of your message to us;
  • position as well as company, and
  • other business data, for example, the name and address of the company (or customer) (to the extent protected as personal data under applicable data protection law).

 

item uses your personal data for the following purposes (in each case only to the extent necessary), in addition to the purposes already discussed above:

  • providing and technical administration of the Website;
  • prevention of misuse/fraud;
  • customer administration and carrying out the online sale;
  • determining customer experience and opinions which relate to the products and services of item to the extent legally permissible;
  • own advertising and third party advertising to the extent legally permissible;
  • improving our internet offering;
  • providing product and service information for customers.

 

Personal data of the users of the Website and our registered customers are generally only forwarded to third parties to the extent this is necessary for the purpose of performing the contract (for example, with regard to payment service providers) and to the extent an express consent was issued.

When collecting, processing and using personal data, however, item can also use service providers (which are not third parties in the sense of data protection law). As data processors, these third parties are required under the contract to only process data for the purposes determined by item (and not for the own, other purposes) and to do so at the instruction of item (see on this point in Section 4). item has concluded so-called data processing agreements accordingly with all data processors which secure this.

Service providers receive from item only those personal data which they need for the specific activity. For example, the email address can be forwarded to a service provider such as Oracle in the context of Eloqua (see on this point, Section 4.3), so that Oracle can deliver the item newsletter. Service providers can also be instructed, for example, to provide computer center services (within the EU), to evaluate the user friendliness of our Website or to provide technical support. Except in a few cases (see sections 4.2, 4.3 below), all service providers have their registered offices in the EU or the European Economic Area. If service providers, in an exceptional case, have their registered office outside the EU or the European Economic Area, item has introduced measures which make sure that all these persons and organizations respect your privacy and only use personal data in accordance with the requirements of applicable data protection law.

It is also important for us to emphasize that service providers cannot forward your data to third parties (or sub-processors) without the consent of item. Transfers of personal data to public authorities or other governmental agencies also only occur to the extent this is permitted under data protection law and this is required by mandatory provisions in national law.

4.1 General information on cookies

The Website uses so-called cookies in order to make your use of the Website as comfortable as possible. Cookies are text data files which are transmitted through the internet browser when the Website is accessed. Cookies are automatically stored on your end-device. Cookies help us to structure this Website in a more user-friendly manner. You can deactivate cookies in the settings of your internet browser which, however, can result in an adverse impact on the function when using this Website. 4.2 Google Analytics

We specifically use the so-called “Google Analytics” Cookie for our Website. Google Analytics is a web analysis service of Google Inc. (1600 Amphitheatre Parkway Mountain View, CA 94043, USA, “Google”). Google Analytics uses cookies which are stored on your end-device and enable the analysis of your use of the Website.

At the request of item, Google uses this information in order to analyze your use of the Website and compile reports about the activities on the websites and in order to provide further services to item involving the use of the websites and the internet use. The IP address transmitted by your internet browser in the context of Google Analytics is not linked to other data of Google and instead is anonymized by using an abbreviation (Google Analytics was expanded in the context of this Website using the code “gat._anonymizeIp”, in order to assure anonymized collection of IP addresses (so-called IP masking). The data collected using Google Analytics are also not used by item to personally identify the visitor of this Website, and the data are not linked to personal data. You can deactivate cookies in the settings of your internet browser, but this can have an adverse impact on the functionality when using the Website (see already on this point above, Section 4.1).

4.3 Marketing automation tool Eloqua provided by Oracle

We use Eloqua, provided by Oracle, on this Website for the registration/log-in and in order to send emails to you. The servers for Eloqua are located in Canada. Eloqua places a permanent cookie on the respective log-in page to the extent that an Eloqua cookie is not already present on your device. If you have already used a website which uses Eloqua, you might already have an Eloqua cookie. We use Eloqua cookie for the purpose of analyzing your use of our site so that we can continuously improve the site. Although this cookie is used on other websites, the information from the visit to our website is only visible for us and is not shared with either Oracle or other users of the Eloqua system. It is also not possible for us to record or review information about your visits to other websites using this cookie.

Emails which are transmitted using Eloqua use tracking technologies. We use these data primarily in order to find out which topics are interesting to you by seeing whether our emails have been opened and which links you click. We then use this information in order to improve the emails which we send to you and the services we provide.

4.4 WebSights

On our website, we use the tool  WebSights powerded by ZoomInfo 7700 Old Georgetown Rd., Suite 500 Bethesda, MD 20814. USA. This tool reveals the identities of organizations that visit our website via an IP algorithm and provides visualized analytics. The IPs we gather are solely known company IPs and are associated only at a company level. The information displayed within the WebSights dashboard does not display any information about the specific individual visiting our website.  Information collected through the use of the WebSights tool is only used to ensure proper function of the ZoomInfo product – ZoomInfo does not repurpose this information or transfer it to any third parties.

The legal basis for this processing of data is Article 6(1)(f) GDPR (legitimate interest). We have a legitimate interest in showing you personalized advertising, and in analyzing the use of our website.

We store your personal data so long as this is reasonably necessary in order to fulfill the purposes for which the data were collected (a consent which you have given to us in this regard also continues to be valid after our business relationship with you ends) as well as in order to comply with the respectively applicable law.

You have the right under data protection law to obtain information about your stored personal data upon request and free of charge. In addition, you also have the right to correct, block and delete these personal data in accordance with the provisions in the law.

We will inform you as comprehensively as possible in writing in accordance with applicable law and upon request whether and which personal data we have stored about you. If wrong information is stored despite our efforts for data accuracy and keeping the data current, we will correct the data at your request.

We do not collect any data about children younger than 13 years intentionally. Children under 13 years do not belong to the target group for our Website. We recommend that parents and guardians actively observe the internet activities and interests of their children.

Our Website is SSL encoded. All data at item are stored on servers in a German computer center. item and its computer center service provider fulfill all technical and organizational measures required by law in order to protect your data in accordance with the general state of the art in technology, especially against laws, falsification or access by unauthorized persons.

In the event that you want to contact us by email, we wish to point out that the confidentiality of the transmitted information cannot be guaranteed. As a general rule, the content of emails can be subject to spying by unauthorized third parties during transmission.

If you follow a hyperlink to one of these websites, please note that we cannot assume any responsibility or warranty for the third party content or data protection conditions, nor do we have any influence on this. item reserves the right to update this Privacy Policy at any time without advance notice (this can become necessary, for example, due to current developments, such as e.g. a revision of data protection law or a potential revision of our Website).
